A former Black Panther will remain in prison until hearings are held to determine whether he'll face another trial in the 1972 killing of a prison guard.
The 5th U.S. Circuit Court of Appeals on Friday granted a motion by Louisiana's attorney general to have Albert Woodfox remain in custody.
A federal judge had overturned Woodfox's murder conviction because of mistakes made by one of his former trial lawyers. He then ordered the state to release Woodfox on bail until it either drops charges against him or retries him.
The appellate court also ordered that the state quickly prepare its arguments in favor of a new trial and that oral arguments be heard in March.
